Terms of Use

WildHQ connects people planning guided trips with the outfitters who run them. We publish the listings and pass on your inquiry. The outfitter quotes you and contracts with you directly. These terms explain what each of us is responsible for.
WildHQ is operated by EquityMasters Labs LLC, a California limited liability company doing business as WildHQ (“WildHQ,” “we,” “us,” “our”). These Terms of Use are an agreement between you and WildHQ covering your use of thewildhq.com and everything we offer through it.
If you list a business on WildHQ, the Outfitter Subscription Terms also apply to you and govern anything you pay us. Where the two documents conflict on a commercial matter, the Outfitter Subscription Terms control.
1.What WildHQ is
1.1WildHQ is a marketplace for guided hunting, fishing, and expedition trips. We publish profiles and trip listings for independent outfitters, and we pass inquiries from people planning trips to the outfitters they contact.
1.2What we currently offer is described in our Service Description, which forms part of these Terms and which we may update as our services change. Today that description says we do not take bookings, hold payments, or charge commission on an outfitter's trips. Where these Terms describe a feature we have not launched, that section applies to you only if and when we make the feature available.
1.3The Service means the WildHQ website, our applications, and every feature, tool, and service we make available through them, now or in future. We may add, change, or withdraw parts of the Service at any time.
1.4These Terms incorporate the following, each of which we may update in accordance with section 20: the Service Description, the Privacy Policy, the Cookie and Tracking Notice, the Acceptable Use Policy, the Content Policy, and the Copyright Policy.
2.Who may use WildHQ
2.1You must be at least 18 years old. WildHQ is not directed at children and we do not knowingly collect information from them.
2.2If you use the Service on behalf of a business, you confirm you are authorized to accept these Terms for that business, and “you” includes it.
2.3You agree to give accurate information and to keep it accurate.
3.Accounts
3.1Some parts of the Service do not require an account. Reading listings and sending an inquiry do not.
3.2Where the Service makes accounts available to you, you are responsible for your credentials and for activity under your account. Tell us promptly if you believe someone else has access to it.
3.3Where the Service lets you save, favorite, follow, or otherwise organize content, that material is a convenience rather than a record we guarantee to keep. Listings change and are removed by the outfitters who publish them.
3.4We may decline to create, suspend, or close an account under section 15.
4.Inquiries and introductions
4.1When you send an inquiry through WildHQ, we pass your details to the outfitter you contacted. They contact you, quote you, and contract with you themselves.
4.2Your inquiry goes only to the outfitter you contacted. We do not route it to any other outfitter, we do not sell it, and we do not distribute it to whoever pays us the most. Nothing stops you from contacting as many outfitters as you like; that is your choice, not something we do on your behalf.
4.3Once your inquiry reaches an outfitter, that outfitter handles your information under their own practices, which are theirs and not ours. Ask them about it if it matters to you.
4.4We may also contact you ourselves, including about your inquiry, about trips and outfitters on WildHQ, and about WildHQ. How we do that, and how you stop it, is in section 13 and in our Privacy Policy.
4.5Do not use the inquiry form to send anything other than a genuine inquiry. Section 11 applies.
5.WildHQ is an introduction service, not a party to your trip
5.1WildHQ is a directory and lead service. When you send an inquiry, it goes directly to the outfitter, who contacts you, quotes you, and contracts with you themselves. WildHQ does not take bookings, handle payments, or act as an agent for either side. We are not a travel agent, tour operator, guide, or broker.
5.2Every trip listing is written and maintained by the outfitter offering it. Prices, dates, availability, licensing, and trip details are theirs, and they can change without our knowledge. Confirm everything directly with the outfitter before you commit.
5.3Outfitters listed here are independent businesses. A listing on WildHQ is not an endorsement, and it does not mean we have inspected an outfitter's operations, licensing, or insurance. Where we do carry out additional checks, they are limited in scope and are not a guarantee of safety, quality, or compliance. Where we display a badge or label describing a check we have carried out, that badge means only what it says next to it.
5.4Any agreement, payment, cancellation, or dispute is between you and the outfitter. WildHQ is not responsible for the conduct, safety, licensing, or performance of any outfitter, or for the outcome of any trip.
5.5Guided hunting, fishing, and backcountry travel carry real risk of injury and death. Outfitters are responsible for the safe and lawful conduct of their trips, and will normally ask you to sign their own acknowledgment of risk and liability waiver. Read it. It is a contract between you and them, and WildHQ is not a party to it.
5.6You are responsible for holding the licenses, tags, permits, and documents your trip requires, and for complying with the laws of the place you are traveling to. Information on WildHQ about licensing or seasons is general and may be wrong or out of date. Verify it with the outfitter and with the relevant authority.
6.Messages between you and an outfitter
6.1Where the Service makes messaging available to you, this section applies.
6.2Messages sent through the Service pass through our systems and are stored there. We may access, retain, and disclose them where we reasonably need to in order to operate the Service, enforce these Terms, resolve a dispute, or comply with law.
6.3We have the right to review messages but no obligation to do so. We do not monitor communications as a matter of course, and you should not assume anything sent through the Service has been read by us.
6.4Do not use messaging to send anything section 11 prohibits, and do not use it to move a transaction off WildHQ in order to avoid a fee that would otherwise apply.
6.5Where the Service offers text-message or telephone contact, we will ask for your consent separately and specifically before sending you marketing by those channels, and you can withdraw it at any time.
7.Prices, availability, and offers
7.1Prices, dates, and availability shown on WildHQ are set by the outfitter. They are indicative, they carry no guarantee, and they can change. A price shown as “from” is a starting figure and not a quote.
7.2We do not verify prices or availability and we are not responsible for errors in them. Confirm current rates directly with the outfitter.
7.3Where the Service lets an outfitter offer specific dates at a stated rate, and lets you respond with an offer or an expression of interest, this section applies. We will publish the rules of that process alongside it, including whether your offer can be withdrawn, what happens if more than one person responds, and whether responding creates any commitment. Unless those rules say clearly that your response is binding, it is not, and it remains an inquiry under section 4.
7.4We are not responsible if an outfitter withdraws an offer, cannot honor a rate, or cannot deliver a trip.
8.Payments
8.1WildHQ does not currently process payments between you and an outfitter. You pay the outfitter directly, on terms you agree with them.
8.2Where the Service makes payment, deposit, or booking features available to you, we will publish the terms that govern them, including how refunds, cancellations, and chargebacks are handled, and those terms will apply to your use of that feature in addition to these Terms.
8.3Nothing in this section obliges us to introduce such a feature, and nothing in these Terms prevents us from doing so.
9.Content on WildHQ
9.1Outfitter content. Profiles, trip listings, prices, photographs, videos, and staff descriptions are supplied by the outfitters they belong to. They are responsible for that material and for having the right to publish it. We do not verify it.
9.2WildHQ content.The WildHQ platform, brand, wordmark, design, editorial writing, and any photography or imagery we create or commission are ours or our licensors'. Where we have built or written material for an outfitter, that material remains ours unless we have agreed otherwise in writing.
9.3Some imagery on WildHQ is created rather than photographed.Where we use a generated image, it depicts the species and the country a listing describes, and we do not use generated imagery to depict an outfitter's camp, lodging, equipment, staff, or clients.
9.4Your content. If you submit anything to WildHQ, including an inquiry, a message, a review, or a photograph, you keep whatever rights you have in it and you give us a worldwide, royalty-free, sublicensable license to host, store, reproduce, adapt, publish, and display it in order to operate and promote the Service. You confirm you have the right to give us that license.
9.5We may remove, edit, or refuse to publish anything on WildHQ, at any time, for any reason or none. We have no obligation to review anything before it is published or to keep anything published.
9.6You may not copy, scrape, index, republish, or build a database from WildHQ content except as an ordinary visitor or search engine would, and except as section 11 permits.
10.Reviews and ratings
10.1Where the Service lets you publish a review or rating, it must reflect your genuine experience. Do not publish a review of a trip you did not take, do not accept anything of value in exchange for a review, and do not publish a review of your own business or a competitor's.
10.2We may remove reviews that breach this section or the Content Policy. We do not adopt or endorse any review, and a review is the view of the person who wrote it.
11.Acceptable use
You agree not to:
11.1use the Service unlawfully, or to publish anything unlawful, fraudulent, misleading, defamatory, or infringing;
11.2impersonate anyone, or list a business you are not authorized to represent;
11.3submit false, automated, or bulk inquiries, or use the inquiry or messaging features to send advertising, spam, or solicitations;
11.4scrape, crawl, harvest, or extract data at scale, or use automated means to access the Service other than as a search engine ordinarily would;
11.5attempt to gain access to any account, account data, or system you are not authorized to access, or interfere with the operation or security of the Service;
11.6circumvent, disable, or test any security, rate-limiting, or access-control measure; or
11.7use the Service to compete with WildHQ, including to build a competing directory or lead product from material published here.
Our Acceptable Use Policy sets this out in more detail and forms part of these Terms.
12.Advertising, sponsorship, and affiliate links
12.1We may display advertising, sponsored placements, and promoted listings on WildHQ, and we may be paid for them.
12.2We may include links to third-party products or services and we may earn a commission when you use them. Where we do, we will say so clearly at the point where the link or recommendation appears.
12.3Sponsored and promoted material will be labeled so it is distinguishable from material we publish editorially.
12.4We do not make, supply, or stand behind third-party products or services, and we are not responsible for them, for the accuracy of an advertiser's claims, or for any dealing you have with an advertiser.
12.5Any commission we earn under this section is not a commission charged to an outfitter on their trips.
13.Privacy and communications from us
13.1Our Privacy Policy explains what we collect, how we use it, who we share it with, and the choices you have. It forms part of these Terms.
13.2By sending an inquiry or creating an account you agree we may email you, including about your inquiry, about trips and outfitters on WildHQ, and about WildHQ itself. Every marketing email we send carries a way to stop receiving them, and we will honor that promptly. Stopping marketing email does not stop email we need to send you about an inquiry you made or an account you hold.
13.3We will not send you marketing by text message or automated call without your separate, specific consent.
13.4We use cookies and similar technologies, and we work with analytics and advertising providers. Our Cookie and Tracking Notice explains what we use, and how to accept or refuse non-essential tracking. Our current providers are listed on the page it links to, and that list changes as our providers do.
14.Copyright
14.1If you believe material on WildHQ infringes your copyright, send a notice to our designated agent as set out in our Copyright Policy. We respond to properly made notices and we may remove the material.
14.2We may terminate the account of anyone who repeatedly infringes.
15.Suspension and termination
15.1You may stop using WildHQ at any time. If you hold an account you may ask us to close it, as described in the Privacy Policy.
15.2We may suspend or close your access, or remove your content, if you breach these Terms, if we reasonably believe you are causing harm or legal risk, or if we stop offering the Service. Where it is reasonable to do so we will tell you first.
15.3Sections 5, 9.2, 9.4, 16, 17, 18, 19, and 21 survive termination.
16.Disclaimers
16.1The Service is provided “as is” and “as available”, without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.
16.2We do not warrant that the Service will be uninterrupted, secure, or error-free, that any content on it is accurate, current, or complete, or that any defect will be corrected.
16.3We make no warranty about any outfitter, including their licensing, insurance, qualifications, safety record, conduct, availability, pricing, or the quality or outcome of any trip.
16.4We do not warrant that using WildHQ will produce any particular result, including any number of inquiries, bookings, or trips.
16.5Some jurisdictions do not allow the exclusion of certain warranties. Where that applies to you, the exclusions above apply to the fullest extent the law permits.
17.Limitation of liability
17.1To the fullest extent permitted by law, WildHQ will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or opportunity, arising out of or relating to the Service, whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we were advised of the possibility.
17.2We will not be liable for anything arising out of your dealings with an outfitter or any other user, including any trip, any injury, any loss of property, any cancellation, and any sum you paid or lost.
17.3Our total liability to you for all claims relating to the Service will not exceed the greater of (a) the total amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred US dollars ($100).
17.4Nothing in these Terms excludes liability that cannot be excluded by law, including for fraud, or for death or personal injury caused by our negligence.
17.5The limitations in this section apply even if a remedy fails of its essential purpose, and they reflect a reasoned allocation of risk that forms a basis of this agreement.
18.Indemnification
18.1You will indemnify and hold harmless WildHQ and its members, officers, employees, and agents against any claim, demand, loss, liability, damage, and reasonable legal cost arising out of or relating to: your use of the Service; anything you submit or publish; your breach of these Terms or of any law; and, if you are an outfitter, any trip you offer or run and any dealing you have with a client introduced through WildHQ.
18.2We may take control of the defense of any claim we are indemnified against, at your expense, and you will not settle it without our written consent.
19.Disputes, arbitration, and class action waiver
19.1Talk to us first. Before starting arbitration, send us a written notice at 1111 6th Ave, Ste 550 #391280, San Diego, CA 92101 describing the dispute and what you want. We will try to resolve it within 60 days. If we cannot, either of us may begin arbitration.
19.2Agreement to arbitrate. Except as set out in 19.3 and 19.5, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator. The arbitration will take place in San Diego County, California, or by videoconference or on documents at your election. The arbitrator decides all issues, except that a court decides whether 19.4 is enforceable.
19.3Small claims and injunctive relief. Either of us may bring an individual claim in small claims court instead of arbitration if it qualifies. Either of us may also ask a court for an injunction to protect intellectual property or to stop unauthorized access to the Service.
19.4Class action waiver. ALL CLAIMS MUST BE BROUGHT INDIVIDUALLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this paragraph is found unenforceable as to any claim, that claim alone proceeds in court and the rest of this section still applies.
19.5Your right to opt out. You may opt out of 19.2 and 19.4 by writing to us at 1111 6th Ave, Ste 550 #391280, San Diego, CA 92101 within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out costs you nothing and affects nothing else in these Terms. If you opt out, section 21.4 governs where disputes are heard.
19.6Fees. The AAA rules govern who pays what. We will pay filing and arbitrator fees to the extent those rules require, and we will not seek our legal costs from you unless the arbitrator finds your claim frivolous.
19.7Time limit. Any claim must be brought within one year of when it arose, or it is waived, to the extent the law allows.
20.Changes
20.1We may change these Terms. If a change is material we will give notice, by email or in the Service, at least 14 days before it takes effect, and we will update the version and date above.
20.2Where a change materially reduces your rights or increases your obligations, we will ask you to accept it, and if you do not, you may stop using the Service and, if you pay us, cancel under the Outfitter Subscription Terms. Continuing to use the Service after a non-material change takes effect means you accept it.
20.3We may change the Service Description and the policies listed in section 1.4 without notice where the change reflects how the Service already works, a change of provider, or a correction. Material changes to those documents are handled under 20.1 and 20.2.
20.4Changes are not retrospective. A dispute is governed by the version of these Terms in force when the events giving rise to it happened.
21.General
21.1Assignment. You may not assign these Terms without our written consent. We may assign or transfer these Terms, in whole or in part, to an affiliate, or in connection with a reorganization, a change of legal entity, a merger, or a sale of all or part of our business, without your consent and without notice.
21.2No agency. These Terms create no partnership, joint venture, employment, or agency relationship between you and us, or between us and any outfitter.
21.3Entire agreement. These Terms, with the documents listed in section 1.4, are the whole agreement between you and us about the Service, and replace any earlier terms, including any previously published on thewildhq.com.
21.4Governing law and venue. These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Where a dispute is not subject to arbitration, you and we submit to the exclusive jurisdiction of the state and federal courts in San Diego County, California.
21.5Severability and waiver. If any provision is unenforceable, it is limited or removed to the minimum extent necessary and the rest stays in force. Our failure to enforce a provision is not a waiver of it.
21.6Force majeure. Neither of us is liable for a failure to perform caused by something outside our reasonable control.
21.7Notices. We may give you notice by email, or by posting in the Service. Give us notice in writing at 1111 6th Ave, Ste 550 #391280, San Diego, CA 92101.
